1. General
These terms apply when you use our website and shop with Ella Byron Bay. By using the website you accept these terms.
2. Eligibility
By using this website you confirm that:
- You have reached the age of majority where you live, or
- You have the consent of a parent or guardian
You may not use the website or our products for unlawful, fraudulent or unauthorised purposes.
3. Formation of the Contract
A contract is formed when you receive an order confirmation from us by email. We reserve the right to refuse or cancel an order before it has been accepted, including in cases of:
- Suspected fraud
- Pricing or listing errors
- Lack of stock availability
- Breach of these terms
If an order is cancelled after payment, the full amount is refunded.
4. Cancellation
Orders may be cancelled within 12 hours of purchase, provided they have not entered processing. After that time the order may already have been:
- Processed
- Packed
- Prepared for shipment
- Handed to a carrier
Once an order has reached these stages, cancellation cannot be guaranteed. If the order has shipped, cancellation is no longer possible and you will need to follow the return procedure in our return policy.
5. Product Information
We aim to present our products as accurately as possible. Please note that:
- Colours may vary depending on screen settings
- Minor variations in texture or appearance may occur
- Product descriptions, availability and prices may change without notice
Obvious errors or inaccuracies are not binding. This does not limit the consumer guarantee that goods will match their description under the Australian Consumer Law.
6. Prices and Payment
All prices are shown in Australian dollars (AUD) unless stated otherwise, and are the total price payable for the item, as required by the Australian Consumer Law. Where GST applies it is included in the price shown. Prices may change without notice. Payment must be made in full before an item is shipped. We use secure, encrypted payment systems. Ella Byron Bay does not store full card details.
7. Delivery
Estimated delivery times are given as guidance only and are not guaranteed. We are not responsible for delays caused by:
- Carriers
- Customs handling
- Incorrect delivery details provided by you
- Circumstances beyond our reasonable control
Risk in the item passes to you on confirmed delivery.
8. Returns and Refunds
Returns are governed by our return and cancellation policy. You may request a return within 30 days of delivery, provided the conditions are met. You are responsible for return shipping unless the return is due to a fault on our side. In addition, you always have our voluntary 14 day change of mind window on distance purchases, as set out in Section 2 of that policy. Your rights under the Australian Consumer Law apply on top of both, and are set out in Section 8 of that policy.
9. Prohibited Use
You may not use the website:
- For unlawful or fraudulent activity
- To breach applicable law
- To upload malicious code
- To interfere with the security of the website
- To abuse customer care
A breach may result in the service being suspended or terminated.
10. Intellectual Property
All content on the website, including images, text, logos, graphics and product descriptions, belongs to Ella Byron Bay. Unauthorised copying, reproduction or distribution is prohibited.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Sections 12, 13 and 14 apply only to the extent the Australian Consumer Law permits.
12. Disclaimer
Subject to Section 11, all products and services are provided as is and subject to availability. We do not warrant that:
- The website will be uninterrupted
- The website will be error free
- All product information is entirely free of minor inaccuracies
13. Limitation of Liability
Subject to Section 11, and to the extent permitted by law, Ella Byron Bay is not liable for:
- Indirect or consequential loss
- Loss of profit or revenue
- Temporary interruptions to the service
- Unauthorised access to user data
Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or paying the cost of doing so. Our total liability will never exceed the amount you paid for the product concerned.
14. Indemnity
You agree to hold Ella Byron Bay harmless from claims or damages arising from your breach of these terms or your misuse of our services.
15. Third Party Services
Our website may use third party services, including payment processors, analytics tools and shipping partners. These services are governed by their own terms. We are not responsible for the actions or terms of third parties.
